This is a case worth keeping tabs on. American Blind and Wallpaper Factory is suing Google for trademark infringement when allowing Adwords users to bid on the company’s name.

This could set a precedent for other cases and would really hurt the Adwords program. As I see it, advertisers should be able to bid on the company name if they don’t use the company name on the ad copy itself. After all, you could argue that when one does a search for a company name, other company listings may show up in the natural search results.

I did a search on the term ’starbucks’ and lo and behold, result #6 was www.ihatestarbucks.com. Should Starbucks sue Google to get that listing off the search results? (Note: I have nothing against Starbucks… it’s just an example)
