Trademarked keywords are commonly entered into the search engines when someone is looking for something on the Internet. From the perspective of the Adwords advertiser, bidding on trademarked terms to trigger their ads can often prove to be profitable. However, Google just lost a case to Geico according to a report on Out-Law.com.
From my understanding, you can bid on the trademarked terms as long as you don’t use them in the text of your ad. At this point, it still hasn’t been decided if the liability lies with Google or its advertisers. This is a case we should all follow.
